1. About these terms
These Terms and Conditions ("Terms") govern the supply of goods and services by Enjoy A Gift ("Enjoy A Gift", "we", "us", "our") to you ("you", "the Client"). By filling out the quote form, placing an order, or paying a deposit, you agree to be bound by these Terms.
Enjoy A Gift is a business operating in Australia (ABN 75 519 522 606). These Terms are governed by the laws of the State of Victoria, Australia, and any dispute is subject to the exclusive jurisdiction of the courts of that State. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be lawfully excluded.
2. Our service
Enjoy A Gift designs and produces bespoke, handcrafted origami gifts and origami gift boxes, personalised to specifications agreed with the Client. Each commission is custom-made to order.
3. Quotes, orders and design approval
Quotes are valid for 14 days from the date of issue unless otherwise stated. A binding order is formed only when: (a) you approve the design deck we prepare, and (b) you pay the required deposit.
You are responsible for reviewing the design deck carefully — including, but not limited to, origami designs, colours, spelling of names and messages, and quantities — before approval. Once approved, production begins and changes may not be possible or may attract additional fees.
4. Pricing, payment and GST
Prices are quoted in Australian Dollars (AUD). Unless expressly stated, prices are exclusive of GST, which will be added where applicable. A deposit of 50% is required to commence production, with the balance payable prior to dispatch, unless otherwise agreed in writing.
Late payment may delay production and dispatch. We reserve the right to suspend or cancel orders where payment is not received by the agreed date.
5. Production timelines
Because each piece is handcrafted, production timelines are agreed at the time of order and depend on quantities, complexity of personalisation and seasonal demand. Timelines quoted are estimates made in good faith; we are not liable for delays caused by matters outside our reasonable control, including courier delays, supply of specialty papers, or force majeure events.
6. Cancellations and changes
Because our products are custom-made to your specifications, deposits are non-refundable once the design deck has been approved and production has commenced.
If you request changes after approval, we will use reasonable efforts to accommodate them and will advise any additional cost or delay before proceeding. Cancellations after production has commenced may attract charges reflecting work already performed and materials procured.
7. Delivery, risk and title
We deliver to you. Risk in the goods passes to you on delivery to the address you nominate. Title in the goods passes only on full payment of the invoiced amount.
You are responsible for providing accurate delivery details. Re-delivery or re-routing due to incorrect address information may incur additional charges.
8. Damage in transit
Every piece is inspected, photographed and carefully packed prior to dispatch. In the unlikely event of damage in transit, please notify us in writing within 3 business days of delivery, with photographs of the outer packaging and the affected items, so we can investigate and, where appropriate, arrange remake or replacement.
9. Personalisation, intellectual property and content you provide
Where you provide us with logos, artwork, names, messages or reference images ("Client Content"), you warrant that you have the right to provide that content and grant us a licence to use it solely for the purposes of producing and delivering your order.
All designs, design decks, sketches, photographs and other materials produced by Enjoy A Gift remain our intellectual property. You are granted a non-exclusive licence to receive the finished gifts. You may not use or reproduce our designs commercially without our written consent.
10. Handcrafted nature and colour variation
Each piece is folded by hand from imported washi and specialty papers. Variation in fold, colour, print and paper texture is a natural feature of the craft and is not a defect. Screen and printed colours may vary slightly from physical materials.
11. Consumer guarantees and our liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
To the maximum extent permitted by law, our liability for any breach of these Terms or of any implied guarantee is limited, at our option, to re-supplying the goods or services, or refunding the price paid. We are not liable for indirect or consequential loss.
12. Confidentiality
We treat details of your commissions, recipients and branding as confidential. We may reference the general nature of work performed in marketing materials (including photographs of finished pieces) unless you tell us in writing that a commission is to remain private.
13. Changes to these Terms
We may update these Terms from time to time. The version applying to your order is the version in force at the time your order is confirmed.
